By accessing or using the services provided by New Era Machining, you agree to comply with and be bound by the following terms and conditions. Please read these terms carefully before engaging our services.
1. Services Provided
New Era Machining provides custom machining, fabrication, repairs, and other related services, including but not limited to:
- CNC machining
- Milling and turning
- Prototyping
- Assembly
We reserve the right to modify or discontinue any services at any time without prior notice.
2. Quotes and Estimates
- All pricing provided by us is an estimate and subject to change based on material costs, labor time, or other factors.
- Written quotes will be provided upon request. Any changes in the scope of work or material requirements may result in additional charges.
- We will notify the customer of any significant changes to the estimated cost before proceeding with the work.
3. Order Acceptance
- An order is considered accepted once the customer has agreed to the quote or estimate and provides written authorization (via email, contract, or purchase order).
- We reserve the right to reject any order for any reason, including but not limited to unavailable materials, excessive order volume, or incompatible specifications.
4. Payment Terms
- Payments are due upon completion of the project unless otherwise agreed upon.
- For ongoing or long-term projects, we may require progress payments based on milestones or at specific intervals.
- Late payments may incur interest charges of 20% per month, and any outstanding balances may result in a suspension of services until full payment is received.
5. Lead Time and Delivery
- Estimated lead times are provided at the time of the quote, and we will make every effort to adhere to these timelines.
- Delays may occur due to factors beyond our control, including but not limited to material shortages, technical issues, or unforeseen circumstances.
- Shipping and delivery charges are the responsibility of the customer unless otherwise agreed upon.
6. Intellectual Property
- All designs, drawings, and other materials provided by the customer for manufacturing remain the property of the customer, unless otherwise specified.
- Any intellectual property developed by New Era Machining during the project, including improvements, modifications, and custom designs, remains our property unless otherwise agreed in writing.
7. Customer Responsibilities
- The customer is responsible for providing accurate specifications and drawings. Any errors in customer-provided materials or designs that result in delays or errors in production will be the responsibility of the customer.
- The customer is also responsible for ensuring that the parts and products comply with all applicable laws and regulations.
8. Quality Assurance and Warranties
- New Era Machining will perform all services with reasonable skill and care, and all products will be manufactured in accordance with the customer’s specifications.
- We offer a 180 day warranty on all finished products to cover defects in materials and workmanship, but this does not cover damages arising from improper use, handling, or external factors.
- If a product is found to be defective within the warranty period, we will repair or replace it at no additional charge, subject to our discretion.
9. Liability and Limitations
- New Era Machining will not be held liable for any indirect, incidental, or consequential damages arising from the use of our services or products.
- Our liability for any claim arising out of this agreement will be limited to the total amount paid by the customer for the specific order in question.
10. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary information, designs, or materials shared during the course of the project. This obligation will remain in effect after the completion of the project.
11. Force Majeure
Neither party will be liable for delays or failure to perform obligations due to events beyond their reasonable control, including but not limited to acts of God, war, natural disasters, labor strikes, or government actions.
12. Governing Law and Dispute Resolution
These terms and conditions will be governed by the laws of United States.
13. Changes to Terms and Conditions
We reserve the right to modify or update these terms and conditions at any time. Any changes will be communicated to customers in advance. By continuing to use our services after such modifications, you agree to be bound by the revised terms.
14. Termination of Services
We reserve the right to terminate services at any time if the customer violates any terms, fails to make payments, or otherwise engages in conduct that hinders our ability to perform the work.
